Terms of Service
These Terms are a contract between you and MogoMogo, Inc., a Delaware corporation, doing business as Mogomed (“Mogomed,” “we,” “us”).
1. Parties and eligibility
These Terms are a contract between you and MogoMogo, Inc., a Delaware corporation, doing business as Mogomed (“Mogomed,” “we,” “us”). You must be 18 years of age or older. One person may maintain one account. You agree to provide accurate information and keep it current.
2. Marketplace role
We are a technology marketplace. We are not a hospital, physician, pharmacy, insurer, fiduciary, or travel agent of record unless a statute says otherwise. Your treatment relationship is only with the independent facility you select. Catalog text is educational, not medical advice. Concierge and any AI features are not a clinician.
3. Authorization to share information
By booking you authorize us to share your name, contact information, requested care, and preferred dates with the named hospital so it can confirm the booking. Results are stored if the hospital or you upload them, as described in the Privacy Policy.
4. Admin Service Fee
The amount due at checkout is Mogomed’s Admin Service Fee for matching, scheduling coordination, and documentation tools, fulfilled when payment succeeds. It is not escrow and not prepayment of clinical care. Remaining listed cash is due at the hospital. Hospitals may charge more if additional services are clinically required; those extras are not Mogomed’s.
5. Booking state machine
Bookings move through pending confirmation, dates offered, confirmed, escalated, completed, or cancelled. Clinic confirmation is when Sanctuary shows Confirmed.
6. Cancellation and modification
Pending confirmation, dates offered, or escalated: full Admin Service Fee refund. Cancel within 48 hours of clinic confirmation: full fee refund. Cancel within 48 hours of your scheduled care date: 50% fee refund. If both windows apply, the more generous refund applies. Modify your reservation at any time; financial adjustments follow this schedule. Clinic-initiated cancellations receive a full fee refund. Refund timing follows Stripe settlement schedules. Amounts due at the hospital are billed by the hospital and are not part of these rules.
7. Traveler obligations
You are responsible for travel documents, recommended travel medical insurance (not included), arriving as instructed, and following hospital intake.
8. Assumption of risk
International care involves different standards, devices, and malpractice systems. It can be hard to sue a foreign hospital from the United States. Complications after return are not Mogomed’s clinical responsibility.
9. Results and translations
Any English text Mogomed generates is a convenience translation that may contain errors. It is not certified medical translation or medical advice. Staff may access files only to operate your trip or a support request; access is logged.
10. HSA/FSA
We do not provide tax advice, file claims, or determine eligibility under IRC §213(d). Wellness and anti-aging services may be excluded. A clinic superbill is the facility’s attestation, not ours.
11. Prohibited uses
You agree not to commit fraud, access other people’s vaults, scrape the platform, or otherwise misuse Mogomed.
12. Intellectual property
The Mogomed mark is owned by MogoMogo, Inc. We grant you a limited license to use the app for its intended purpose.
13. Privacy
Our Privacy Policy describes how we handle information, including international transfers to partner hospitals.
14. Disclaimers
THE SERVICE IS PROVIDED AS IS. We do not warrant clinical outcomes, slot availability, reimbursement, or translation accuracy.
15. Limitation of liability
To the extent allowed by law, our aggregate liability is capped at the Admin Service Fees you paid us in the prior 12 months. Some states do not allow certain limitations; those carve-outs apply where required.
16. Indemnity
You indemnify MogoMogo, Inc. d/b/a Mogomed for your travel, your attestations, and your misuse of the service.
17. Disputes
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Disputes shall first be addressed through informal resolution with support; unresolved claims may be brought in binding arbitration in Wilmington, Delaware, except where consumer law prohibits, with a small-claims carve-out. Counsel must mark any CA/NJ exceptions before live charges.
18. Electronic signatures
You consent to electronic signatures for checkout, HSA packets, and the clinic portal under the E-SIGN Act.
19. Modifications
We may update these terms with notice via email or in-app notice. Acceptances are versioned. Continued use after the effective date constitutes acceptance of the updated terms where permitted.
